
Has Jersey’s WHISTLEBLOWING proposed laws been kicked into the long grass (or touch!!)?

Jersey planned to introduce legal measures that would provide protection and compensation for whistleblowers, like the protections available in the UK. This move will encourage openness and transparency without fear of reprisal, addressing concerns that whistleblowers face significant risks such as retaliation, legal consequences, and career impact.
It was reported in the news on 29 June 2023 that Deputy Carina Alves proposed legislation to protect whistleblowers in Jersey. The news report quoted Deputy Carina Alves as follows:-
Deputy Carina Alves said:-
- It’s an area that is lacking, unlike in the UK, where an employee can be remunerated for loss of income and reputation if they disclose illegal, unjust, or harmful actions in their workplace.
- it would be a step toward encouraging openness and transparency without fear of reprisal.
- "Although policies are in place for the Government as a whole and local organisations can choose to put a whistleblowing procedure in place internally
- And are encouraged and recommended to do so by the Jersey Financial Services Commission, who also have a special whistleblowing hotline
- There are no legal measures in place to protect and compensate whistle-blowers, for example, from loss of employment after a disclosure, unlike in the UK, which has caused great concern.

IN 2023, the states started acting:-
- INTRODUCTION OF LEGISLATION (P.47/2023): AMENDMENT Lodged au Greffe on 11th July 2023 by the Minister for Social Security Earliest date for debate: 18th July 2023

And the goal was to have this legislation approved by the Assembly before the end of December 2024
