Jersey primarily adopts UK sanctions through its legislative framework.
- The Sanctions and Asset-Freezing (Jersey) Law 2019 (SAFL) and
- The Sanctions and Asset-Freezing (Implementation of External Sanctions) (Jersey) Order 2021 (SAFO)
This framework allows Jersey to implement.
- The United Nations Security Council (UNSC) and
- Autonomous UK sanctions without delay.
Adoption of Specific Sanctions Lists
- OFSI’s List of Entities Subject to Capital Market Restrictions: Jersey implements financial sanctions, including those related to capital market restrictions, through the SAFL and the External Sanctions Order. This means entities listed by the UK’s Office of Financial Sanctions Implementation (OFSI) are also subject to restrictions in Jersey.
- HM Treasury’s List of Individuals and Entities Subject to Financial Sanctions for Alleged Terrorist Activity: Jersey enforces financial sanctions against individuals and entities involved in terrorist activities, aligning with HM Treasury’s list.
- The Home Office’s List of Proscribed Terrorist Groups and Organisations: Jersey adopts the UK’s list of proscribed terrorist groups and organisations under the Terrorism Act 2000, ensuring these groups are also banned in Jersey.
- The Department for International Trade’s UK Strategic Export Control Lists: Jersey adopts the UK Strategic Export Control Lists, including the UK Consolidated List of Strategic Military and Dual-Use Items that Require Export Authorisation and the UK Military List. These lists determine whether products, software, or technology intended for export are controlled and require an export license.
By aligning with these UK sanctions and control lists, Jersey ensures its compliance with international standards and obligations, maintaining robust measures against terrorism, proliferation, and other threats.
