
The GFSC revised the enforcement process after Royal Court feedback and operational experience.

Considering feedback received from the Royal Court and operational experience of enforcement matters, the Guernsey Commission has revised and updated certain key documents relating to the enforcement process:
- An updated GUERNSEY FINANCIAL SERVICES COMMISSION INVESTIGATION AND DECISION-MAKING PROCESS RELATING TO THE USE OF ENFORCEMENT POWERS
- This Explanatory Note is intended to inform the way in which the Guernsey Financial Services Commission (the “Commission”) approaches the exercise of its statutory powers that involve the exercise of the Commission’s Enforcement Powers.
- The Explanatory Note does not hold the force of law. Each case will be considered on its own merits and in accordance with the requirements of the Financial Services Business (Enforcement Powers) (Bailiwick of Guernsey) Law, 2020.
- While it will generally be followed, in exceptional circumstances, the Commission may depart from the process described in this document.
- The objective of this document is to enable those affected to understand where they are in the process.
- To that end, as far as possible, the Commission will make sure to let those affected know when the process described here is being applied, and when significant departures from it occur.
