The JFSC has updated its whistleblowing page on its website, although there have been no fundamental changes to its whistleblowing processes and procedures.
- The JFCS SAYS:-
- The JFSC understands that making a report can be difficult, and you may have questions about what will happen next.
- The updated page gives more details about what you can expect from the process, including what is considered whistleblowing and what is not.
- The updated pages improve user experience and give more information about the process of making a report,

WHISTLEBLOWING ABOUT WHOM:
- You can report your concerns to the JFSC in confidence If you are aware of WRONGDOING by:-
- Any of the firms the JFSC regulates, or
- Any individual connected to one of these firms.
WHAT IS NOT WRONGDOING FOR JFSC WHISTLEBLOWING POLICY
- Complaints based on personal grievances or
- Being unsatisfied with a service.
WHAT IS A WRONGDOING COMPLAINT INCLUDEs:-
- Breach of legal obligation
- Miscarriage of justice
- A company or person is carrying out unauthorised business in Jersey.
- A company or person is not meeting regulatory requirements.
EXAMPLES OF WRONGDOING WORTHY OF WHISTLEBLOWING
- Breach of a legal obligation, For example,
- An employer neglects their reporting obligations under the Money Laundering Order (Jersey) 2008 by encouraging the money laundering reporting officer not to file suspicious activity reports.
- Miscarriage of justice. For example,
- A staff member has been fired for something that turned out to be a computer error.
- A company or person carrying out unauthorised business in Jersey. For example,
- A business must have the correct licences to do specific business.
- A company or person needs to meet regulatory requirements. For example:-

THE JFSC INTELLIGENCE DIVISION.
- The JFSC Intelligence division is responsible for working with whistleblowers; they ensure that confidential communication and anonymity are protected.
MAKING A WHISTLEBLOWING REPORT
The JFSC will need to know:-
- The firm or individual's name
- What the suspected wrongdoing is
- Who is involved?
- How long has it been going on?
- What the impact is
- If you have any supporting documents or evidence, you can share them.
THE JFSC SAYS IT DOES NOT ENCOURAGE WHISTLEBLOWERS TO
- Proactively obtain more information from any source, whatever the circumstances, as this might break the law.
- However, the JFSC may ask whistleblowers to clarify the information they have already provided.
WHAT HAPPENS WHEN YOU CONTACT THE JFSC?
- You will be assigned a contact to whom you can arrange to speak whenever you can.
- The JFSC will:
- Listen to your concerns in full.
- Take the time to understand your concerns.
- Ask relevant questions to help The JFSC gather information or clarify any information you give them.
NEXT STEPS
- The JFSC create a report.
- If the concerns are within The JFSC remit, they will create a report and determine what can be done to address your concerns.
- The JFSC may share this report with other regulators or public bodies if appropriate.
- This report will not identify you in any way.
- The JFSC make enquiries.
- The JFSC independently reviews the concerns raised and any other relevant information available to The JFSC or held in the public domain.
- Consider any necessary action.
- The JFSC will consider the information you have provided and the outcome of any further enquiries they make. If appropriate, the JFSC may consider further action.
- This information is confidential, and the JFSC cannot advise you of any progress or outcome.
WHAT THE JFSC WILL NOT DO
- The JFSC will not:-
- Keep you updated on progress.
- Provide feedback on the information provided.
- Promise that.
- The JFSC will open an investigation following your concerns,
- You will be exempt from further regulatory action depending on the information the JFSC may find following any investigation.
- Give a reward or any compensation for the information you provide.
